Terms and conditions for [Y] Active Start (ages 3-5)
Monthly Membership: I agree that I will maintain membership and pay monthly. I agree that I will be liable for dues until I provide notice in writing (via email) that I no longer wish to attend. Failure to attend the Classes does not relieve me of the obligation to pay the full tuition for the program in which I am currently enrolled.
First Payment: I understand my first payment is due on the start date.
Next Payment: I understand my next payment is due on the same day each calendar month.
Membership Renewal: This membership will automatically renew on the same day each month.
Membership Cancellation: I understand I may cancel this membership at any time (in writing, via email), a minimum of 30 days prior to the membership renewal date.
Photos and videos: I acknowledge that Engineered Bodies Strength & Conditioning (EBSC) or any party designated by Engineered Bodies may photograph or film me while I attend the premises and use any and all such photos, video footage and/or video streaming for promotion, sales, publicity and advertising purposes for all media, including, but not limited to, the internet.
Gym Rules: I acknowledge I will follow the direction of the coach during classes as well as any other rules conveyed by Engineered Bodies. I understand that I am expected to follow good gym etiquette.
Positive Attitude Clause: EBSC strives to create a positive and supportive environment that is inclusive, diverse and equitable. By accepting the terms and conditions, you agree to treat all EBSC members and staff with respect, dignity, equity and courtesy. Engineered Bodies reserves the right to cancel at any time, without notice, the membership of any member that is found to be creating a hostile environment for other members or staff.
Hold Policy: EBSC allows members to place a temporary hold on memberships for no charge for the following reasons:
Work trips, 14 days or more in duration,
Vacations, 14 days or more in duration,
Medical reasons, including surgery, rehabilitation or critical injury.
A note from a member's physician, therapist, surgeon or other medical professional overseeing their care must be provided. The note must include a date when the member is expected to be cleared for activity.
In all cases, the member must provide, in writing (e.g. via email), the date the hold should start and end. The notice in writing must be provided prior to the date of the hold start. Holds will not be backdated.
If a member wishes to hold their membership for reasons other than those listed above, a surcharge of $50 per month will be applied for the duration of the membership hold. A hold of this nature may be cancelled at any time. The maximum time for such a hold is six months, after which the contract will resume.
Privacy: EBSC is committed to protecting the privacy of personal of our customers. We make every effort to ensure that the information you share with us is recorded accurately, retained securely and used only according to your wishes. We collect personal details necessary to communicate with you and manage our ongoing business relationship with you. If you have any questions about how your personal information is handled or distributed, or if you wish to receive a full copy of our full privacy policy, please contact our privacy officer.
Rights & Obligations: I understand my rights and obligations as stated above. I confirm that I am the full age of eighteen years (unless otherwise indicated below) and that I have read and understood this release and waiver of liability and I am aware that by signing this Agreement I am waiving certain legal rights, including the right to claim damages which I or my heirs, executors, administrators, successors or assigns my have against EBSC.
Right of cancellation: You may cancel this Agreement from the day you enter the Agreement until 10 days after you receive a copy of this Agreement. You do not need a reason to cancel. If you cancel this contract, EBSC has 15 days to refund your money. To cancel, you must give notice of cancellation by email to: info@engineeredbodies.ca
You must give notice of cancellation by a method that will allow you to prove that you gave notice, including registered mail, electronic mail, facsimile or personal delivery. If you send the notice of cancellation by registered mail, electronic mail, or facsimile, it doesn't matter if the seller receives the notice within the required period as long as you sent it within the required period.
